2. Terms Applicable to Users

2.1 Users must provide true, accurate, current, and complete Registration Details during registration and update these details (except age) as necessary before using the Service further.

2.2 Users warrant to ANProperty that they are at least 18 years old and legally capable of entering contracts.

2.3 ANProperty may withdraw any Material from the Website without notice and refuse any Material deemed Unacceptable or inappropriate.

2.4 User Registration Details and usage data will be recorded by ANProperty but will not be disclosed to third parties (except on an aggregated, anonymous basis) or used for purposes unrelated to the Service, unless required by law or a governmental authority.

2.5 ANProperty may place a cookie on the User’s device to track behavior and enhance the user experience. This cookie does not identify the User personally. Users may reject cookies, but this may limit access to parts of the Website.

2.6 By submitting information, Users authorize ANProperty to use it for Service-related communications, including special offers and marketing. Users may opt out by emailing enquiry@anpropertybd.com with “unsubscribe” in the subject line.

2.7 Users who do not wish their data to be used as described in Clauses 2.4 and 2.6 should refrain from submitting personal details.

2.8 ANProperty reserves the right to suspend or terminate a User’s account at its discretion, notifying the User by email. Terminated Users must not attempt to re-register directly or indirectly.

2.9 ANProperty provides a Service, not goods, acting as an intermediary platform for property listings.

2.10 ANProperty owns all Intellectual Property Rights in the Website and Service, including design, text, graphics, and their arrangement.

2.11 ANProperty takes infringement of Intellectual Property Rights and fraud seriously. Users should report such issues to enquiry@anpropertybd.com, and ANProperty will inform relevant authorities.

2.12 Users may submit feedback on other Users’ integrity and performance via email to ANProperty.

2.14 By submitting Material, Users grant ANProperty a royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, distribute, display, modify, and edit the Material. ANProperty may remove or edit Material at its discretion without payment to the User.

2.15 Users warrant they have all necessary rights to grant the license in Clause 2.14 and that their Material is not Unacceptable.

3. Limitation of Liability

3.1 ANProperty is not liable for indirect, consequential, or incidental losses, including loss of profits, revenue, data, or goodwill, or for any User’s liability to third parties arising from these Terms.

3.2 While ANProperty strives to exclude viruses from the Website, it does not guarantee their absence and accepts no liability for viruses. Users should take appropriate safeguards before downloading Material.

3.3 ANProperty is not liable for ensuring Material is not Unacceptable. Users make decisions based on Material at their own risk.

3.4 ANProperty is not liable for Service interruptions, whether intentional or otherwise.

3.5 ANProperty is not liable for failures due to third-party software or services.

3.6 ANProperty is not responsible for consequences of Users linking to external websites from the Website.

3.7 These clauses do not restrict liability for death or personal injury caused by ANProperty’s negligence.

3.8 ANProperty’s maximum aggregate liability for direct losses (or other losses not excluded by Clauses 3.1–3.6) shall not exceed twice the amount paid by the User to ANProperty related to the claim.

4. Warranties and Indemnity

4.1 ANProperty does not warrant that information on the Website is accurate, complete, or current. Users rely on such information at their own risk.

4.2 Material is not tailored to individual User needs. Users are responsible for ensuring Material meets their requirements before entering transactions.

4.3 All warranties, express or implied, are excluded to the fullest extent permitted by law.

4.4 Users agree to indemnify ANProperty against all liabilities, claims, and expenses arising from any breach of these Terms by the User.

5. General

5.1 These Terms, along with any incorporated documents, constitute the entire agreement between the parties. No party relies on representations not expressly included herein, except for fraudulent misrepresentations.

5.2 ANProperty may amend these Terms at any time. The Effective Date is stated above. Users should check for updates before using the Website and only continue if they accept the new Terms.

5.3 If any provision is void, it is deemed deleted, and the remaining provisions remain in effect.

5.4 ANProperty may assign or subcontract its rights and obligations under these Terms.

5.5 Users may not assign or transfer their rights or obligations without ANProperty’s written consent.

5.6 Notices may be served by email or post to the User’s last known contact details. Notices are deemed received: immediately if served personally; 24 hours after email transmission; or 72 hours after posting if sent by pre-paid mail.

5.7 ANProperty is not liable for delays or failures due to causes beyond its control, including acts of God or governmental regulations.

5.8 Any delay in enforcing these Terms does not waive ANProperty’s rights.

5.9 Headings are for convenience and have no legal significance.

5.10 These Terms are governed by Bangladeshi law, and the parties submit to the non-exclusive jurisdiction of Bangladesh courts. ANProperty may pursue Intellectual Property Rights enforcement in any relevant jurisdiction.
